BarTag Terms of Service

These Terms of Service (“Terms”) are an agreement between you and BarTag. They apply when you visit or use BarTag's website, app, private links, and related services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Adults Only

You must be at least 21 years old to use BarTag. The Service is not directed to anyone under 21. You are also responsible for following the laws that apply where you are.

2. What BarTag Is

BarTag is a private, voluntary social game. A player opens a Round with a selected venue, beverage, message, and Proof photo, then tags someone else through a private link. Players can add their own social moment and keep the Round going.

Alcohol may be part of the setting, but it is never required. A beverage can be alcoholic or nonalcoholic. “Completing” or “finishing” a turn means submitting the response and photo; it never means consuming or finishing a beverage. A Proof photo establishes the moment, not alcohol consumption.

3. Participation Is Voluntary

You decide whether to open, accept, continue, or leave a Round. Do not pressure, shame, haze, threaten, or coerce anyone to participate, drink, finish a beverage, visit a venue, or share content. Respect a person's choice not to join or respond, and do not send repeated unwanted Tags.

4. Responsible and Safe Use

You agree to use good judgment and to:

  • never drink and drive or use BarTag while driving;
  • never create or encourage dangerous drinking challenges;
  • follow applicable alcohol, traffic, venue, and public-safety laws;
  • stop participating when doing so would be unsafe; and
  • seek appropriate help in an emergency instead of relying on BarTag.

5. Accounts and Guest Participation

You may be able to participate as a guest or through an account. You are responsible for information submitted through your account, browser, or private participation link and for keeping access links and account credentials secure. Tell us promptly if you believe your account or a private link has been misused.

6. Tags, Contact Information, and Messages

You may submit another person's name, email address, or phone number to tag them. Only provide contact information you are reasonably permitted to use, and use it only to support the voluntary BarTag interaction. BarTag may send an email to an eligible recipient. Text messages created through BarTag are sent by you through your own messaging app; BarTag does not currently send automated SMS messages.

7. Private Links and Sharing

Rounds are private by default and accessible through their private links. They are not guaranteed to be confidential. Anyone who receives a link may forward it, and viewers may copy, download, or screenshot what they can see. Share links only with people you trust.

BarTag may show limited, aggregated activity from completed Rounds on public TagMap and Places pages, such as venue names, approximate map points, connections between venues, and activity counts. Private Round photos, messages, beverage details, contact information, and participant identities are not listed there as part of the private Round.

8. Venue Information

Selecting a venue is currently required to submit a BarTag moment. Venue information is chosen by participants and may include a place name, address, and provider-supplied map coordinates. Do not use a venue selection to misrepresent where someone else is, disclose a sensitive location, or invade another person's privacy.

9. Your Content and Other People's Rights

You keep ownership of content you submit. You give BarTag a worldwide, nonexclusive, royalty-free license to host, store, reproduce, adapt for technical display, and show that content as needed to operate, secure, and improve the Service and to provide the sharing and public aggregate features described in these Terms.

You must have the rights and permissions reasonably necessary to submit your content. Respect other people's privacy, publicity, copyright, and other rights. Before posting another person's image or location, consider whether they reasonably expect it to remain private and obtain permission when appropriate.

10. Prohibited Content and Conduct

You may not use BarTag to:

  • break the law or encourage illegal or dangerous conduct;
  • harass, threaten, stalk, shame, haze, or impersonate someone;
  • post hateful, sexually exploitative, or unlawfully explicit content;
  • share content that infringes another person's rights or privacy;
  • send spam, repeated unwanted Tags, or deceptive messages;
  • introduce malware, scrape the Service, evade access controls, or disrupt operation; or
  • misrepresent a Proof photo as evidence that someone consumed alcohol.

11. Beta Service and Changes

BarTag is a beta service. Features may be incomplete, interrupted, changed, or removed. Data may be lost, and the Service may not always be available or work as expected. Do not rely on BarTag as the only copy of important content or as a safety, emergency, or recordkeeping tool.

12. Suspension, Removal, and Ending Use

We may limit or suspend access, deactivate links, or remove content when reasonably necessary to protect people, operate the Service, investigate misuse, comply with law, or enforce these Terms. You may stop using BarTag at any time. To request account or content deletion, contact us as described below; some information may be retained when reasonably necessary for security, legal, or operational purposes.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” BarTag disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. BarTag does not control participants, venues, link recipients, or third-party services and does not guarantee their conduct, safety, or accuracy.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, BarTag will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities, arising from the Service or these Terms. BarTag's total liability for all claims relating to the Service will not exceed the greater of $100 or the amount you paid BarTag in the 12 months before the event giving rise to the claim.

These limits do not apply where applicable law does not permit them or to liability that cannot legally be limited.

15. General Terms

If a provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms and the Privacy Policy are the entire agreement between you and BarTag about the Service, except for any additional terms we expressly present for a feature.

Applicable law governs these Terms without regard to conflict-of-law rules, and disputes may be brought in a court with lawful jurisdiction. Nothing in these Terms limits rights you cannot waive under applicable consumer law.

16. Changes to These Terms

We may update these Terms as BarTag changes. We will update the date above and provide additional notice when required. Your continued use after updated Terms take effect means you accept them.
